			<content:encoded><![CDATA[<p>In California, if you will or sell your house to your children, there is no property tax reassessment as there would be if you were to sell it outright.  However, if you have two children and will the house at 50% to one and 50% to the other, and one sibling forces the other to buy them out, this savings goes out the window.  Because of the forced sale, the purchasing sibling will have to pay property tax after a reassessment.  This would, no doubt, raise that sibling’s tax liability by thousands.  There are, however, ways to avoid this scenario.</p>
<p>You could simply will your house to the child who needs it the most.  This could cause an unfair distribution of assets and the financial circumstances of your children might well change between the writing of your will and your death.  Therefore, the child who needs the house most now, might not be the child who needs it most upon your death.  You could simply will the house to one child and all other assets to the other.  Again, this may lead to an unfair distribution of assets.  Lastly, you can set up a revocable living trust and give the trustee discretion to mortgage the house so the property can go to the sibling who is the buyer and the seller receives the loan proceeds, equalizing the asset distribution and keeping the property from being reassessed at a higher tax.</p>
<p>Unfortunately, you cannot pass the right to own the house without reassessment to anyone except children.  Therefore, no matter what adjustments or assigns you make in your will, unless you pass the house to one or all of your children, the inheritor will face a reassessed property tax.  Many people have thought that they have come up with ways around this provision, but the tax law in California pretty much has you cold.</p>
<p>That is because of a rule called the step transaction doctrine.  This rule states that any number or steps of transactions made to avoid taxation will be treated the same as a single transaction and will face taxation as such.  For example, if you state in your will that you are leaving your house to your daughter with the intent that she sells it to her daughter (your grandchild), the state will consider this to be one transaction.  That one transaction would be the sale of your house to your granddaughter.  Since grandchildren are not qualified for the exemption of reassessment, the property would be reassessed and your granddaughter would have to pay increased property taxes.  She would not benefit from her mother’s ability to leave the house to her, without reassessment, as her mother did from you.  That is because the transaction would be seen as an attempt to avoid reassessment of the property tax, which would be true.  It is unclear how long your daughter would have to own your house before she could sell it to her daughter without the property tax reassessment, although she should be able to do so at some point.</p>
<p>Remember that we are talking California law here, as an example of how complex property taxation can become.</p>

To promote voluntary resolutions, the IRS instituted a program known as Offer in Compromise. This IRS tax relief program is more commonly known as IRS tax settlement or tax settlement. You have undoubtedly seen the marketing promotions on TV and heard them on the radio touting that you can “settle your IRS tax debt” for less or “settle your IRS tax debt for pennies on the dollar”. </p>
<p> The offer in compromise program was designed to let taxpayers with back tax problems resolve their problems voluntarily. Instead of waiting for the IRS to catch up to them, taxpayers could come forward and essentially admit their sins and request tax debt help. In exchange for this voluntary action, the IRS would consider a reduction of the tax debt amount that was past due including penalties and interest. This IRS tax relief program was a big success. </p>
<p><strong>What is IRS tax settlement? </strong> The Offer in Compromise program is essentially a “compromise” or “settling” of the past due IRS tax debt liability. This means that the IRS is willing to accept a smaller portion of what is owed as payment in full on the delinquent tax debt. The IRS does this because they realize it is unlikely that the full amount will ever be collected from the taxpayer. Not surprisingly, the IRS does not take accepting a tax settlement offer lightly, and the taxpayer must demonstrate that it is in their best interest to settle rather than attempt to collect in full on the tax debt. A complete financial disclosure is required from the taxpayer, including all assets held. It is critical that the proposed offer be accurate and complete, and for that reason, many taxpayers use a professional <a rel="nofollow" onclick="javascript:pageTracker._trackPageview('/outgoing/article_exit_link');" href="http://www.irs-tax-debt-settlements.com/">IRS tax settlement</a> service to handle the filing of the application. <p>This info is for a freind whom has consulted w/ an atty. and stated that the only option is a settlement. This party does not have the money for a settlement nor enough assets to sell off to erase the tax liability. All wages garnished and personal asset(s) i.e. car has lien attached. Bankruptcy won&#8217;t work due to this is non-dischargeable debt. This person understands the need to pay and has a good job-salary, but the IRS has left her/him with $333 to live on ea. month. Bascially poverty-stricken. No doubt the gov&#8217;t has legal basis to due this, but, but, I believe it&#8217;s unfair/ unjust to propel a person into dire straits with collection efforts. If the garnishment was not at the present level e.g. leaving this person with say $1000 to live on monthly, it would be affordable. I don&#8217;t think the IRS&#8230; tax system, was setup to render a preson homeless or otherwise. Thank you for any assistance.</p>

<p>Despite how hopeless the situation looks, it really may not be. The IRS is offering you a way out of so much debt and would like for you to come forward and ask for help. You see, many times, the IRS will accept a smaller portion than what is actually owed if you can prove that you can&#8217;t afford to pay the whole thing. You and the IRS can come to an agreement of what to pay, a reasonable amount when considering income level and other debt that you have accrued. They are fair when they look at case files, and base the decisions on formulas that they use.</p>
<p>If you are in a situation where the money can&#8217;t spread out any thinner then apply for a settlement. Have proof to show what you can and cannot afford. Be careful while filling out that application, and be honest with them. They may show some leniency and will be able to help you through this time.</p>
