i live in indiana and my attorney told me the judge can make me sign a paper letting my ex-husband claim my daughter on his taxes.I want to know can this judge make me give him permisssion to claim her on his taxes?she lives with me all year.

Does he pay Child support? If he does he is legally allowed to do that in some states.

In most cases you are to rotate years that you claim the child if there is only one. Ex: You claim her in 2008, he claims her in 2009, you 2010…etc…I don’t know how much money you make, but if you qualify for the earned income credit…You can still claim her on your earned income credit and he can claim her as a dependent, that way you both get a break. If not…then you will probably have to rotate years. That’s pretty common practice.

nope, not unless its your idea and not the Judges. He doesnt have the power to override the IRS in this matter. If you out right refuse, there isnt much anyone can do about it, since you have your child more than half the year with you under your roof
Why would you think your attorney is lying to you? He’s not.
If Dad’s paying child support, a judge can order that he be allowed to claim the child as a dependent on his taxes, even if the child lives with you. However, I think it’s more common (in some states anyway) that they order you to take turns claiming the child. So you would claim her one year and he would claim her the next.
